Terms of Service

1. Agreement to Terms

By accessing or using the Kidoglow platform — including kidoglow.com, my.kidoglow.com, and kids.kidoglow.com (collectively, the "Services") operated by Kidoglow — you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

If you are using the Services on behalf of a child, you represent that you are the child's parent or legal guardian, that you accept these Terms on their behalf, and that you are responsible for your child's use of the Services through their profile.

2. Eligibility

You must be at least 18 years old to create a Kidoglow parent account. The kids app is intended for children ages 4–12 and may only be accessed through a profile created by a parent or guardian. Children may not create accounts independently.

3. Accounts and Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.

4. Using the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes. You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the Services or its systems.
• Reverse engineer, decompile, or disassemble any part of the Services.
• Use the Services to transmit harmful, offensive, or inappropriate content.
• Interfere with or disrupt the integrity or performance of the Services.
• Create accounts using automated methods or false information.
• Attempt to bypass or circumvent parental controls or access restrictions.
• Upload, share, or distribute content that exploits, harms, or endangers children in any way.
• Impersonate another user, parent, or child.

5. Intellectual Property

All content, features, and functionality of the Services — including text, graphics, logos, icons, images, audio, software, and the overall design — are owned by Kidoglow and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.

6. User Content

You retain ownership of any content you submit through the Services (such as profile information and settings). By submitting content, you grant us a limited license to use, store, and process it solely for the purpose of providing and improving the Services.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Please review it carefully.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. We are not responsible for any content or data loss resulting from your use of the Services.

9. Limitation of Liability

To the fullest extent permitted by law, Kidoglow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

10. Service Availability

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Services.

11. Termination

We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms or if necessary to protect the Services or our users. You may also delete your account at any time. Upon termination, your right to use the Services ceases immediately. Deletion of your data is handled in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the effective date at the top of this page. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Services will be resolved through good-faith negotiation first. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration administered under the rules of the applicable arbitration body in the province of the operator. You agree that any dispute resolution will be conducted on an individual basis and not as a class, consolidated, or representative action.

14. Survival

The following sections survive termination of these Terms: Intellectual Property, User Content, Disclaimers, Limitation of Liability, Governing Law and Disputes, and any other provisions that by their nature should survive.
